HELD: The proposed operation to separate conjoined twins resulting in the death of one of the twins is lawful. Although Mary's death is foreseeable as an inevitable consequence of the operation, the invasive surgery is intended and necessary to save Jodie's life. Mary's death is not a purpose or intention of the surgery, and she will die only because her body, on its own, was never viable.
HELD: The Alaska Constitution's guarantees of privacy and liberty do not afford terminally ill persons the right to a physician's assistance in committing suicide and Alaska's statute prohibiting suicide assistance does not violate their right of equal protection.
HELD: A conservator of the person may not withhold tube feeding from a conscious conservatee who is not terminally ill, comatose, or in a persistent vegetative state, absent clear and convincing evidence that the conservator's decision is in accordance with either the conservatee's own wishes or his best interest.
HELD: Before tube feeding may be withdrawn from a person who is unconscious, pursuant to the directives of a living will, there must be a finding by clear and convincing evidence that the patient is in a "persistent vegetative state" as defined in her living will, or in a "permanent unconscious state" as defined by state statute.
