National Practitioner Data Bank: more guidelines, more problems.

The complex reporting requirements under the National Practitioner Data Bank are further complicated by numerous exceptions and conflicting interpretations. Even after two years of operation, many physicians and reporting entities are unfamiliar with the system and its problems. In an apparent attempt to clarify the requirements, the Department of Health and Human Services, in 1992, issued a supplement to its 1990 guidebook for users. Unfortunately, this supplement causes even greater confusion and fails to correct existing inconsistencies with respect to such critical issues as summary suspension and medical malpractice settlement reporting.

Medical staff and hospital: a delicate relationship.

The relationship between hospitals and medical staffs has become increasingly delicate over the last several years. The interests of the hospital and the medical staff are diverging and may conflict. It is important to acknowledge these differing interests before solutions can be reached and a stronger relationship built.

Avoiding traps and pitfalls in National Practitioner Data Bank compliance.

Quirks in the National Practitioner Data Bank regulations and operations may catch medical staffs and hospitals unawares, creating potential traps and pitfalls that could result in exposure to lawsuits and federal sanctions. In this article, the author outlines several areas of possible difficulty and offers tips to help medical staffs avoid problems in these areas.

Contracting assistance, California-style.

The California Medical Association's Division of Physician Contracting and Medical Staff Affairs serves as a clearinghouse of data on the numerous and varied entities offering contracts to physicians in California and in other states. In addition to disseminating this information, it offers specific analysis on a contract-by-contract basis to members of the association and to other physicians and groups, and it presents seminars on contractual agreements and negotiation.
