Health care reform is changing the medical profession and the way physicians manage their patients, including reducing the incentive to practice defensive medicine. Conflicting pressures on physicians make this an ideal time for medical malpractice tort reform.

The Evers case: 1984 decision has lasting impact.

In 1984, the Supreme Court of New Jersey established the standard for determining physician liability for the delay in the diagnosis of cancer. The effects and implications of that 1984 decision are lasting. The case involved a failure to diagnose breast cancer.
