Protection against employment claims.

Risk managers already deal with a great many issues in today's complex, managed-care driven, healthcare environment. Now they must add expertise in handling ever more complicated employment issues. This article addresses areas risk managers need to both know and understand concerning this area of law, and some steps they can take to minimize loss or provide for insurance protection for any loss.

Information technologies need to protect patient confidentiality.

To meet the needs of an increasing number of persons who require access to patient information, health systems have devoted significant financial resources to developing computerized medical records. As these enterprisewide information systems go online, however the risk of compromising patient confidentiality increases dramatically. State laws regarding patient confidentiality vary considerably, and national standards have not yet been established. Therefore, health systems need to take steps to ensure that their computerized patient records remain secure and confidential to avoid being found in violation of patients' legal right to privacy.

Telemedicine and the law.

Telemedicine is a compelling healthcare delivery option that allows physicians in isolated and rural areas to access a full range of specialists and cutting-edge technologies usually available only at large, urban medical centers. However, there is uncertainty in the healthcare community about the impact this new technology will have on professional liability. A lack of legal precedents makes it difficult to determine how the courts would respond to malpractice claims related to the practice of telemedicine. Providers of telemedicine can limit the potential for liability exposure by clarifying physician licensure issues, revising physician credentialing procedures, establishing practice standards, videotaping telemedical procedures, safeguarding computerized medical records, and learning more about the impact of telemedicine on malpractice insurance rates.
