Professional versus personal ethics: methods for system reform?

Abstract

It has been suggested that changes in, and more vigorous enforcement of, professional ethical codes might lead to significant improvements in the quality of expert testimony by mental health professionals. The author examines the arguments for and against this thesis, and concludes that lack of consensus on controversial issues is likely to impede implementation and enforcement of meaningful ethical codes. He argues that attempts to educate the courts and legislatures through writings, testimony, and interdisciplinary teaching are more likely to be effective for the foreseeable future.

Preventing female-perpetrated sexual abuse.

Sexual abuse and sexual assault are serious public health concerns. Although almost all of the research shows that the majority of sexual perpetrators are males, there is growing evidence that female-perpetrated sexual abuse is not rare and that the consequences of female-perpetrated sexual abuse can be just as traumatic as male-perpetrated sexual abuse. Despite this, there has been very little research published that has focused on female sex offending. Furthermore, although there have been some efforts in the past decade to stop sexual offenses by targeting potential perpetrators, few efforts have specifically focused on preventing females from becoming sex offenders. In an attempt to fill this gap, this article describes common characteristics of female sex offenders; and, based on these characteristics, suggestions are given of possible ways to intervene in the lives of at-risk females before they offend.

Firearm laws, patients, and the roles of psychiatrists.

OBJECTIVE: Persons with mental illness and/or substance abuse are frequently perceived by the public to be dangerous. This has resulted in an increase in state legislation restricting their ability to purchase, possess, register, obtain licensure, retain, and/or carry a firearm of any sort. The purpose of this article is to educate clinicians about the impact of firearms statutes and restrictions for their patients. Many state statutes mandate that treating psychiatrists report such gun possession to state justice or police departments. Psychiatrists may also have a statutory role in an appeals process. METHOD: The firearms statutes of the 50 states, the District of Columbia, and Puerto Rico and the Federal National Firearms Act were surveyed, with particular attention paid to the ability of persons with mental illness and/or alcohol or substance abuse to obtain firearms. The results were tabulated. RESULTS: These statutes are not uniform. They vary in their definition of mental illness, the type and duration of gun restriction, reporting practices, the confidentiality of medical information, and the immunity of clinician reporters and appeals processes. CONCLUSION: Clinicians would be wise to familiarize themselves with the provisions of the relevant statutes in their particular states. This will allow them to identify the consequences to their firearm-possessing patients, understand their own roles and obligations -- if any -- and better consider potential clinical and ethical issues for particular patients.
