In the course of recent health care fraud investigations against TAP Pharmaceuticals (Lake Forest, IL) and AstraZeneca International (London, United Kingdom), each pled guilty to one violation of the Prescription Drug Marketing Act, settled claims related to alleged violations of the False Claims Act without admitting guilt, and paid fines, settlements for liabilities, and reimbursements of dollar 850 million and dollar 355 million, respectively. In a unique aspect of these cases, federal investigators brought criminal charges against 14 TAP employees and investigated the billing practices of several urologists. These investigations resulted in guilty pleas from both urologists and industry employees relative to the Prescription Drug Marketing Act or the False Claims Act and probationary sentences with payments of fines and restitution to the government for urologists who cooperated with federal investigations. One uncooperative urologist was found guilty of violating the Federal False Claims Act and sentenced to 6 months of home arrest, excluded from Medicare for 5 years, required to provide 600 hours of free medical care to indigent patients and patients covered by Medicare or Medicaid, and paid fines and restitution to the government. The cases against TAP and AstraZeneca have been followed by federal and state investigations of allegedly illegal marketing practices of other pharmaceutical firms and have resulted in negotiated settlements of dollar 3.8 billion and dollar 71.5 million, respectively. Believing that an Average Wholesale Price-based reimbursement system was an important driving factor for these marketing activities, Medicare has shifted to an Average Sales Price-based reimbursement system. This is expected to greatly impact the practice of outpatient oncology nationwide.

A corpse of a female was found in her apartment in a state of advanced putrefaction. Both hands were amputated, the external genitals were excised and the body parts had been removed from the scene. The subsequent investigations proved that the body parts had been severed post mortem. The cause of death was determined to be manual strangulation. A 33-year-old man later confessed that he had strangled the victim 9 days prior to discovery of the body and that he had had sexual intercourse post mortem. According to the confession, the rational motive for the subsequent mutilation was to eliminate biological stains (e.g. semen inside the vagina, epithelial cells below the fingernails from scratching) suitable for forensic DNA analysis. This constitutes a new type of defensive mutilation intended to prevent the identification of the perpetrator. An increase in the occurrence would be detrimental to the elucidation rate of homicides: in a total of 171 homicides investigated at this institute, DNA analysis of biological stains gave reliable evidence in 45 cases.

Secular trends in the criminal activity of conduct disordered adolescents admitted as psychiatric in-patients in Norway were examined. A nationwide sample of 650 adolescents hospitalised with DSM-IV Conduct Disorder during the years 1963-1990 was followed up 12-33 years after index hospitalisation by register linkage to the National Crime Register. In all, 469 patients, 82% of the males and 57% of the females, had a criminal record at follow-up. The study population was divided into four consecutive cohorts and gender-specific cohort differences in registered criminality were investigated, using survival analysis. There was a marked increase and subsequent levelling off in overall registered criminality from the first to the most recent cohort of conduct disordered females, in contrast to unchanged crime rates in conduct disordered males. Monitoring specific types of crime, males' violent crime rates initially increased but levelled off in more recent cohorts, whereas female violent crime rates increased steadily, with the highest level seen in the most recent cohort. A marked increase in drug offences was observed in both genders. Cox regression demonstrated numerous strong cohort effects, even when controlling for other important factors, including substance use comorbidity. Research into causal mechanisms is warranted.

This paper briefly reviewed literature relating to medical disputes and investigated the criminal judgments of the Supreme Court in Taiwan in cases involving nurses and the delivery of nursing services. Past studies of criminal judgments involving medical dispute have usually been presented in the form of case studies. By contrast, this study used a retrospective data, and analyzed the judgments by content analysis and the quantitative research design method. The original written verdicts were obtained from two major online law databases. There have been a total of 70 criminal judgments related to medical disputes since 1927. Among them, 7 cases involved nurses and the delivery of nursing services. These 7 cases were analysed, and the findings will be instructive to those interested in lawsuits related to medical disputes.
The study describes personality traits and the presence of personality disorders and mental disorders in a consecutive series of 130 male prisoners in Swedish jails sentenced for serious criminality. The investigation included a psychiatric examination by means of the Structured Clinical Interview (SCID) as well as information taken from criminal records. Personality assessments were made by means of self-report questionnaires, the Karolinska Scales of Personality (KSP) and the DSM-IV and ICD-10 Personality Disorder Questionnaire (DIP-Q). The most common mental disorders were alcohol and drug abuse/dependence, which were present in 55% of the subjects. Personality disorders, too, were common, being present in 56% of the subjects. In the KSP, high scores were found in scales related to impulsiveness, sensation-seeking, nervous tension and distress, cognitive-social anxiety, hostility and aggression. Very low scores were found in the Socialization scale, reflecting a high degree of psychopathy-related personality traits. Despite the high morbidity, the global level of functioning was unexpectedly high, 66 according to GAF. The male prisoners sentenced for heavy criminality had a high degree of both mental disorders and personality disorders. Furthermore, psychopathy-related personality traits were common.
