[The new law on occupational safety].

The Swiss Federal Parliament has passed a law on accident insurance on March 20, 1981. It will come into force on January 1, 1983, and will replace the second section of the sickness and accident insurance law. The new law provides revised regulations for work safety for all employers and employees. the obligations of employers and employees for the improvement of work safety are extended in some points. the Federal Council will regulate the competence of the Swiss National Accident Insurance Fund and the federal and cantonal Work Inspectorates. A coordination commission should ensure the appropriate use of these executive bodies and the uniform application of safety regulations in places of work. The law further assigns the financial responsibility for work safety through additions to the premiums charged for insurance against accidents at work.

[Patient's consent to the furnishing of a dermatologist report and "physician's notice in suspected occupational disease"].

Neither section 5 of the Statute on Occupational Illnesses nor Lt no. 59 of the "physicians' agreement" stipulates whether a physician should have the right to issue a "green report" or a "dermatologist's report" without the consent of the patient. The decisive regulation for this question is section 100 of the social legislation book (SGB X). In connection with other decisions, this regulation has the following consequences: (1) the consent of the patient is always necessary if the "green report" or the "dermatologist's report" is issued at the request of the treating physician or any other physician, i.e., not at the request of the accident insurance company; (2) if the accident insurance company demands that the "green report" or the "dermatologist's report" be issued, the treating physician does not need the patient's consent. However, a physician who is not the treating physician always requires the patient's consent before the dermatologist's report can be issued. As a rule, the physician can assume the consent of the patient. If not, it depends in individual cases on whether consent is not granted expressly or conclusively. The decision then rests with the physician.

Rate of occupational accidents in the mining industry since 1950--a successful approach to prevention policy.

This paper deals with the decrease in the rate of accident insurance claims in the German mining industry over the last five decades. It intends to show that this process is above all the result of a prevention policy where companies and the body responsible for the legal accident insurance in the mining industry, the Bergbau-Berufsgenossenschaft (BBG), work hand in hand. A system like the German accident insurance scheme, combining prevention, rehabilitation, and compensation, enables successful and modern safety and health measures.

[Return to work after occupational accidents and occupational diseases].

The key formula "by all suitable means" is a structural support for successful occupational reintegration. In this respect, the special system of accident insurance administered primarily through the "Berufsgenossenschaften" (BG), differs from the other branches of social security. This system's roots in civil law do not allow any comparison with the principle of public law insurance underlying the other branches of social security in Germany. Under the statutory accident insurance scheme, the employer, i.e., the liable party within the employment relationship, has to compensate any health damage incurred by an employee, subject to the principles of compensation for damages under civil law, in a manner enabling the employee to return to his position in worklife and in society as unscathed as possible. From this general mandate by the legislator, the social partners involved within the self-management of the BGs draw their strength and their dynamics in arranging for organizational methods within the-administrative offices and in cooperation with the health care providers. This control of rehabilitation, i.e., the accident insurance system's share of the responsibility for successful rehabilitation, contributes a great deal to reentergrating insured persons into work and career, returns valuable workers to the employers, thus having a favourable effect for the gross national product of a society, and last but not least provides a support for the social state.

[Mental health damages in social insurance].

Disablement Insurance As a rule there cannot be claimed medical measures for treatment of schizophrenia, cyclic and organic psychoses, neuroses, hypochondria and hysteria. A mental disturbance substantiates the claim for the disablement pension if due to its seriousness the utilization of the working capacities of the insured on the labour market cannot be demanded or if such a utilization is not bearable for the society. Compulsory Accident Insurance The Swiss Accident Insurance Organization is only liable for those neuroses that are in an adequate causality to the accidental occurrence it covers. Here belong the genuine accident neurosis, the fear neurosis and the therapy neurosis, however not the covetous neurosis. Health Insurance The insured afflicted with a neurosis cannot claim the sickness benefit as long as he is capable to overcome his reluctance to the assumption of sufficient work.
